中新社北京5月17日电 (记者 张素)中国最高人民法院、最高人民检察院等部门17日对外发布关于办理证券期货违法犯罪案件工作若干问题的意见。其中明确，依法从严从快从重查处财务造假、侵占上市公司资产、内幕交易、操纵市场和证券欺诈等违法犯罪案件。
意见提出，证券发行人、控股股东、实际控制人、董事、监事、高级管理人员、金融从业人员等实施证券期货违法犯罪的，应当依法从严惩处。全链条打击为财务造假行为提供虚假证明文件、金融票证等的中介组织、金融机构，为内幕交易、操纵证券期货市场犯罪实施配资、操盘、荐股等配合行为的职业团伙，与上市公司内外勾结掏空公司资产的外部人员，构成犯罪的，应当依法追究刑事责任。
这份意见由最高人民法院、最高人民检察院、公安部、中国证券监督管理委员会联合制定，共31条，包括“行政执法与刑事司法的衔接”“刑事案件的管辖”“证据的收集、审查与运用”等内容。
意见在总体要求部分明确，坚持零容忍要求，依法从严打击证券期货违法犯罪活动。加大查处力度，坚持应移尽移、当捕则捕、该诉则诉，严格控制缓刑适用，加大财产刑适用和执行力度，最大限度追赃挽损，完善全链条打击、全方位追责体系。
围绕坚持依法从严打击，意见提出，对具有不如实供述罪行或者以各种方式阻碍办案工作，拒不退缴赃款赃物或者将赃款赃物用于非法活动，非法获利特别巨大，多次实施证券期货违法犯罪，造成上市公司退市、投资人遭受重大损失、可能引发金融风险、严重危害金融安全等恶劣社会影响或者严重危害后果等情形的犯罪嫌疑人、被告人，一般不适用相对不起诉、免予刑事处罚和缓刑。
